3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Be at least 16 years of age (or the age of majority in your jurisdiction)
• Use only one account per person unless authorized for business purposes

4. Subscription Plans and Billing

We offer a 7-day free trial for new users. No credit card is required to start the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the subscription fee plus any applicable taxes.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings.

4.4 Refunds

We offer a 30-day money-back guarantee for annual subscriptions. Monthly subscriptions are non-refundable. Refund requests must be submitted within 30 days of the initial purchase.

We reserve the right to modify pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle.

5. Acceptable Use Policy

Content generated by our AI features is provided for your use. You are responsible for reviewing and editing AI-generated content before publishing. We do not guarantee the accuracy, originality, or appropriateness of AI-generated content.

6.3 Our Content

The Service, including its design, features, and documentation, is owned by EziPosts and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

7. Third-Party Platforms and Integrations

The Service integrates with third-party social media platforms including but not limited to Instagram, Facebook, Twitter/X, LinkedIn, TikTok, Pinterest, YouTube, and others.

• Your use of these platforms is subject to their respective terms of service
• We are not responsible for changes to third-party APIs or platform policies
• Platform availability and features may vary based on third-party restrictions
• You are responsible for complying with each platform's community guidelines
• We may modify or discontinue integrations based on third-party requirements

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Service Availability and Modifications

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EziPosts, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless EziPosts and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

14. Dispute Resolution

14.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@eziposts.com to attempt to resolve the dispute informally within 30 days.

14.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the decision shall be final and binding.

14.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
